Title A Study on Disputes in Contract Performance Management ¡V A Case Study of Landscape Construction stage

  • Abstract This research is for common types of contract management disputes during the construction of landscape projects. Through a survey, which explores the views of industry professionals on contract clause design, performance satisfaction, preferences for dispute resolution methods, and the perceived effectiveness of these mechanisms.
    The survey points out the mid- to senior enginners with experience in landscape engineering. A total of 40 surveies were distributed, and 30 of them valid responses were collected, resulting in a 75% response rate. The findings indicate that the primary issues of disputes are construction quality, delays and budget overruns caused by design changes, and inconsistent interpretations of contract terms. Among the opinons of those enginnerswho took the sruveies that ¡§settlement¡¨ was deemed the most feasible and practical solution.
    Based on the statistical results and expert feedback, this study bring out three key conclusions: (1) unclear or ambiguous contract clauses are a major source of conflict, underscoring the need for clearer and more consistent contract language; (2) ineffective real-time communication and coordination by the supervising party often exacerbate on-site conflicts; and (3) the industry generally lacks structured training in dispute resolution, resulting in overreliance on personal experience. The study recommends improving contract clarity, establishing dispute resolution training systems, and enhancing the supervisory unit¡¦s real-time response capabilities as practical guidance reform and implementation for system of the future.
